Photography Policy

1. Introduction

Sing Up Group Ltd (“Sing Up”, "us", "we", "our") is committed to protecting the privacy of children, students, or anyone we work with, and maintaining the security of any personal information received. We strictly adhere to the requirements of the data protection legislation in the United Kingdom and the EEA.

The purpose of this statement is to explain the practices by which Sing Up and its partners adhere to when taking, using, or storing photography. Photography or photographs in this statement include photographic prints, video, film and digital imaging, created using devices such as cameras, video cameras, phones or tablets, etc.

This statement should be used in conjunction with Sing Up’s Privacy Notice, which will further elaborate which personal information we may collect, retain, process, share, and transfer, as well as Sing Up’s security standards in terms of processing and storing data.
 

2. Taking photography

Sing Up (www.singup.org) provides schools and teachers with a wide range of musical, educational and training resources to ensure that all children and young people have regular access to high-quality singing activities. The production and promotion of our work often requires us to use photography.

Photography taken by Sing Up, or by a 3rd party working on behalf of Sing Up, are concentrating exclusively on capturing children or individuals participating in music or school activities. We will ensure that the students or individuals are appropriately dressed and are not participating in activities that might cause embarrassment, vulnerability, or bring the individuals or the organisations involved into disrepute.

Examples of photography taken, used, or shared by Sing Up can be found on www.singup.org.

If a 3rd party working on behalf of Sing Up is taking or processing photography, Sing Up will assess that this 3rd party complies with high levels of confidentiality and best practice in privacy and security standards, especially in relation to children.

When taking photography, approved business equipment will be used wherever possible. If it is necessary to use non-business equipment, such as a personal mobile phone, or video camera, the photography will be handed to Sing Up at the earliest opportunity and deleted from the personal device instantly.
 

3. Usage and sharing

The photography taken at the school or organisation may be used by Sing Up with no time limit in a range of Sing Up’s materials which includes (but is not limited to) Sing Up’s website, Sing Up magazine, training videos, webinars, advertisements and other publicity materials such as leaflets, brochures, posters, newspaper and magazine articles.  

In any of the above publications, to protect the student’s identity, the use of information will be avoided which can identify the student in relation to a photograph, such as full name, hobby, school name, etc. 

The photography taken at the school or organisation is shared with the school or organisation and may be used for their marketing purposes. The school or organisation may not share the photography with any other 3rd party or use the photography for any other purpose than stated. 

Sing Up may contract a third party to take and process photography.

Sing Up may share photography taken with trusted third parties. These may include information management applications (e.g. data storage provider, image processing applications), and photography shared with these third parties will be shared for the purpose of image processing. Sing Up may share photography taken with other trusted third parties, such as news agencies, blogs, online or physical magazine providers. Photography shared with these third parties will be shared in relation to content provided by or relating to Sing Up that is approved by Sing Up. Sing Up will only share photography required for a particular purpose. The third party may not share the photography with any other 3rd party or use the photography for any other purpose than stated. 

Photography shared with any 3rd party by Sing Up will be deleted or anonymised, to the extent permissible by applicable law, in accordance to section 4 of this statement, or when Sing Up stop using the third-party service .

 

4. Copyright and consent

The copyright of any photography and any subsequent intellectual property which arises from them will belong to Sing Up. 

Sing Up and the school or organisation are working together closely in obtaining consent from the parent/guardian of a child participant OR adult participant prior of the photography event. Any consent form distributed and received will be kept safe by the school or organisation. To respect individual’s data privacy, Sing Up does not require access to the consent forms returned to the school or organisation.

At the photography event, the school or organisation will be keeping track where consent has not been provided and will be ensuring sensitively the affected students do not appear in any photography taking place.

Consent to the use of images can be changed or withdrawn at any time by the parent/guardian of a child participant OR adult participant by notifying Sing Up in writing via email on [email protected] or post to Sing Up, Gateshead International Business Centre, Mulgrave Terrace, Gateshead, NE8 1AN, United Kingdom. The school or organisation and Sing Up will immediately notify the other party in writing of this consent change or withdrawal. Sing Up and the school will comply immediately with the consent change or withdrawal for the affected photography, although it will be impossible to withdraw or change photography already published.
 

5. Photography shared with Sing Up

Occasionally, Sing Up will receive photography from schools, organisations, or individuals, capturing children or individuals participating in music or school activities (“3rd party content”). Before publishing or sharing such content, Sing Up will ensure to check appropriate consent has been provided by the participants or their guardian/parent. Copyright of 3rd party content and any subsequent intellectual property which arises from them will belong to the 3rd party. Sing Up will comply with any changes to consent as soon as notified.
 

6. Changes and Updates

The published date (“Last Updated Date”) states when the policy was last modified. Our policy may change from time to time and we advise that you review this policy regularly. Any updates will be posted on this page and will be effective as of the Last Updated Date.
